'Regular Shop' - Terms and conditions

These are the terms and conditions which apply when you use our Regular Shop Service (“the Service”).  Please read this agreement carefully. These terms should be read in combination with the 'Use of Website' terms and conditions, our Online Grocery terms and conditions and our Privacy Policy. They represent the terms and conditions for using the Service and by registering for and using our Regular Shop Service you accept these terms and conditions.

You are permitted to use our Service solely on the basis of these terms and conditions. We reserve the right, at our discretion, to update and/or revise these terms and conditions and your continued use of the Service signifies your acceptance of any changes. Please check periodically for changes. The amended terms and conditions will take effect from the time they are first published on the Website, and from then on will govern the relationship between you and us in respect of your use of the Services.  If you have any questions relating to these terms and conditions please contact our Customer Care Team by email, or call us on 0800 328 1700 / 0330 123 1962 between 8am - 11pm. Please note that all calls to us are free from BT land lines, mobile providers and other networks may vary. Calls may be recorded for training and security purposes.

1.  Registration

1.1  Regular Shop is a pilot Service and registration is by invitation only.

1.2 Once your registration is complete, a regular shop will be delivered to you each week or fortnight and your registered payment card will be charged unless you cancel your order.  

1.2 The Regular Shop Service applies only to online grocery orders purchased from www.sainsburys.co.uk/groceries and not to any other products or services we offer or sell.

1.3 To register for Regular Shop you must be over 18, have a valid Sainsbury's Online Grocery account and have completed at least one online grocery order prior to registration. If you do not have a Sainsbury's Online Grocery Account please register here.

1.4 By registering for this Service you agree that the details provided by you on registration, or at any time, are correct and complete.  You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.  You must give us your real name, address, phone number, email address and any other details that we may require to process your order. You must agree to our processing of your personal information in accordance with our Privacy Policy.  If you do not agree with the terms and conditions or our Privacy Policy you should not create an account with us and may not use the Service.

 

2.  The Service

2.1 Regular Shop is a free Service.

2.2 During registration you will be asked to choose a regular delivery slot on a weekly or fortnightly basis.  A Regular Shop will be automatically reserved for you during that slot unless you change or cancel it.

2.3 Thereafter, we will automatically book your preferred slot as soon as it becomes available except where the slot is not available for technical or operational reasons.  If we are unable to reserve your slot for technical or operational reasons we will let you know.

2.4 Following registration, you must create a Regular Shopping list.  Your Regular Shopping list may be created from the items you included in your last online grocery delivery, or, by selecting items from your ‘favourites’ or, by selecting available items from our online grocery website.  Once created, your Regular Shopping list (“My Regular Products”) will be shown under the tab ‘Manage Regular Shop’ and may be edited by you at any time.  We recommend that you review this list prior to your first delivery. 

2.5 Your access to the Regular Shop Service will commence once we have notified you by email that we have created your Regular Shop.

2.6 You may view the order status of each reserved delivery slot.  We will reserve your preferred delivery slot as soon as it becomes available, typically 3 weeks prior to delivery. 

2.7 Our online delivery service is not available on Easter Sunday or from 23-26 December or 1 January each year.  Regular Shop delivery slots may be restricted during our peak Christmas week.  If your Regular Shop delivery slot falls on a day we do not deliver you will need to book an alternative delivery slot manually.

2.8 All Regular Shop deliveries are subject to a minimum order value of £25 after any discounts or e-vouchers have been deducted.  Our usual delivery charges apply.  Click here for details.

2.9 Regular Shop may be used with Delivery Pass.  All Delivery Pass orders are subject to a minimum order value of £40 after any discounts or e-vouchers have been deducted.

2.10 You may have a maximum of one Regular Shop order per week.  If you require additional grocery deliveries please book a delivery slot manually.

2.11 Regular Shop may be used only in association with the registered Sainsbury's Online Grocery account and by the registered account holder only. It may not be used by other users. It may be used to deliver to an address other than your delivery address (such as a holiday home).   We reserve the right to ask for proof that you are associated with all delivery addresses.

2.12 A regular shop will be delivered to you each week or fortnight and your registered payment card will be charged unless you cancel your order.   

 

3.  Cancellation

3.1 You have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to change your mind without giving a reason and cancel your registration for Regular Shop. 

3.2 To cancel your membership, simply click on ‘Manage Regular Shop’ and click Cancel Subscription.

3.3 Your cancellation will take effect immediately and will apply to all future orders except those showing the status ‘Order Due’.  If you wish to cancel ‘Orders Due’ you must edit the order and cancel each order showing this status manually.

3.4 Regular Shop operates a fair usage policy. We reserve the right to suspend your membership of the Regular Shop Service if we consider that your use is not reasonable, for example if you regularly forget to cancel an order you do not want, or use the Service fraudulently.

 

4.  Editing your order

4.1 You may edit your ‘My Regular Products’  list, including the frequency of delivery at any time by clicking the ‘Manage Regular shop’ tab.

4.2 You may choose to have a Regular Shop delivered every week or fortnightly.

4.3 You may choose to have individual items in your weekly or fortnightly Regular Shop delivered on a weekly, fortnightly or 4-weekly basis.

4.4 We will automatically reserve your Regular Shop delivery slot as soon as it becomes available, typically 3 weeks prior to delivery.  Once reserved, a slot will show the status ‘Slot Reserved’.   

4.5 We will automatically check the validity of your payment card 4 days prior to delivery following which the status of your order will change to ‘Order Due’.

4.6 You may edit (delete, amend, or add to) your My Regular Products list at any time and these amendments will apply to future orders except orders showing as ‘Order Due’.

4.6 You may edit (delete, amend or add to) any order showing the status ‘Slot Reserved’ or ‘Order Due’.  These amendments will apply to those orders only and not to any future orders.  The status of a ‘Slot Reserved’ will change to ‘Order Due’ following any edit by you.

4.7 You may edit an order showing the status ‘Order Due’ at any time up to 11pm the day before delivery.  You must checkout again to save any changes.

4.8 When editing an order you may choose to add an item to that order only by clicking the ‘add’ tab.  If you wish to include the item in all future deliveries, please click the ‘Regular Shop’ tab.

4.9 You may edit your preferred delivery slot by using the ‘Manage Regular Shop’ tab.  This change will apply to all future orders except those showing as ‘Order Due’ or ‘Slot Reserved’.  Delivery slots for ‘Order Due’ and ‘Slot Reserved’ may be edited manually.  All amended delivery slots are subject to availability.

 

5.  Pricing

5.1 The Prices shown in your ‘My Regular Products’,‘Order Due’ and ‘Slot Reserved’ are guide prices.  The prices you will be charged for goods will be the actual prices displayed in the store where your goods are selected, on the day of delivery. 

5.2 Promotional offers will be applied to your Regular Shop provided your order meets any minimum order requirement. 

5.3 If you edit an ‘Order’ Due’ or ‘Slot Reserved’ we will show you at checkout any promotions which could apply to the goods you have selected.  To qualify for a promotion, eg a multi-buy, you may need to add additional items to your basket.

 

6.  Payment

6.1 You may pay for your Regular Shop using any valid Debit or Credit card already linked to your existing ‘My Account'. Your payment details are held in an encrypted form on the Sainsbury’s database and will only be used for payment on account and/or payment of goods and services received by you.

6.2 You will not be charged until your order is ready for delivery.

6.3 If we are unable to process payment, your Regular Shop will not be delivered until we are able to do so.  Our Customer Care Team will contact you to request new details.  Once authorised, your Regular Shop will be delivered.  If we are unable to contact you, your Regular Shop delivery will be delayed until we are unable to do so.

6.4 We will remind you when a registered payment card is due to expire.  Please register a new card.  If we are unable to process a payment following expiry of your card our Customer Care Team will contact you to request new details.  Once these are authorised your Regular Shop will be delivered.  If we are unable to contact you, your Regular Shop membership will be suspended until such time as we are able to do so.

6.5 You can collect Nectar points with Regular Shop provided your Nectar card is linked to your Sainsbury’s Online Grocery Account.  See nectar.com/collect/sainsburys.points for details. You may not pay for your Regular Shop with Nectar points.

7.  Grocery Returns

7.1 If whilst inspecting goods at the time of delivery, you identify goods you do not want, you are free to decline any product delivered by your driver for any reason (including the price) on delivery.  You can return them to the driver and ask them to take them away.

7.2 Any goods you return to our driver will be automatically refunded to the credit or debit card used to make the payment and shown as a refund on the next payment card statement.  Refunds take upto 3-5 working days to reach your account.

7.3 After the driver has left, you have the right, except for the excluded items listed below in 7.4, to return goods and/or faulty goods in line with Sainsbury’s store returns policy.  Goods not returned to our driver at the time of delivery should be returned by you at your expense with your receipt or other proof of purchase to any convenient Sainsbury’s store within 28 days in original packaging in saleable condition. 

7.4 Unless of poor quality or faulty, it is not possible to return baby food and milk, frozen or perishable food and drink, CD’s, DVD’s, audio or visual software where the seal has been broken or newspapers and magazines.

7.5 Any refund due will be credited to the purchaser’s card within 3-5 working days.  The delivery charge will be refunded only where the entire order is returnable (eg does not include perishable food) and the entire order is returned within 28 days.  If returned items were part of a promotional offer or vouchers used, the amount refunded may be reduced.

 

8. General information:

8.1 You may not use Regular Shop if you intend to use the items delivered for resale or onward delivery by you or a 3rd party.

8.2 We reserve the right to charge a delivery fee if you or an adult is not available to receive an agreed delivery.

9. Regular Shop change or termination

9.1 We reserve the right to change or withdraw Regular Shop membership benefits or suspend the Regular Shop Service at any time and for any reason.

9.2 We reserve the right to change and update these terms and conditions from time to time. If we do so, we will update our website with the revised terms and conditions.  Continued use of the Service implies your acceptance of the amended terms and conditions.

9.3 We reserve the right to monitor usage of Regular Shop and to terminate individual membership of the Service if we believe that:
       - A member is in breach of the fair usage policy
       - A member is in breach of any term or condition
       - A Regular Shop member has engaged in activity that we suspect involves fraud or the misuse of Regular Shop membership

9.4 We reserve the right to assign or sub-contract any or all of our rights and obligations under these terms and conditions.

10. Our Liability

10.1 Nothing in these terms and conditions excludes, restricts or affects your statutory rights.

10.2 We do not warrant that the Service will meet your specific requirements or the quality of any products purchased from us will be fit for any particular purpose unless obvious.

Our liability for any loss you suffer as a result of us breaching this agreement is strictly limited to the purchase price of the goods.

10.3 This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

10.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us and even if such losses result from a deliberate breach of these Terms by us that would entitle you to terminate the contract between us, including but not limited to loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings; or loss of data.

 

11.  Events beyond either party’s control

11.1 Except in respect of a payment obligation, neither party will be liable for any failure to perform any obligation owned to the other due to reasons beyond its reasonable control, for example, industrial disputes, technical difficulties, failure of or delays in communications networks, acts of terrorism or power failure.

 

12.  Entire Agreement

12.1 Save as otherwise expressed in these terms and conditions, these terms and conditions, together with 'Use of Website' terms and conditions, our Online Grocery terms and conditions and our Privacy Policy contain the entire agreement between us and you relating to your use of the Service.

 

13.  Waiver and severance

13.1 In the event that any provision of these terms and conditions is held to be illegal, invalid, or unenforceable, such provision will be severed and the remainder of these terms and conditions shall remain in full force and effect.

13.2 If you breach these terms and conditions and we take no action against you we will still be entitled to enforce our rights against you in relation to that breach and to use our rights and remedies in any other situation where you breach these terms and conditions.

 

14.  Governing Law

1.4.1 These terms and conditions and any dispute or claim arising out of on in connection with them or their subject matter or formation are governed by and are to be construed in accordance with English Law.

14.2 You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of or in connection with these terms and conditions.
