These are the terms and conditions which apply when you buy our Delivery Pass service. Please read this agreement carefully. These terms should be read in combination with the 'Use of Website' terms and conditions, our Online Grocery terms and conditions and our Privacy Policy. They represent the terms and conditions for using this service and by purchasing a Delivery Pass service you accept these terms and conditions.
You are permitted to use our Website solely on the basis of these Terms and Conditions. We reserve the right, at our discretion, to update and/or revise these Terms and Conditions. Please check periodically for changes. If you have any questions relating to these Terms and Conditions please contact our Customer Care Team by email, or call us on 0800 328 1700 between 8am - 11pm. Please note that all calls to us are free from BT land lines, mobile providers and other networks may vary. Calls may be recorded for training and security purposes.
1. Membership
1.1 The Delivery Pass service applies only to online grocery orders purchased from www.sainsburys.co.uk/groceries and not to any other products or services we offer or sell.
1.2 To purchase a Delivery Pass you must be over 18 and have a valid Sainsbury's Online Grocery account. If you do not have a Sainsbury's Online Grocery Account please register here.
1.3 Once purchased, the Delivery Pass is valid for 1, 6 or 12 months. Following expiry, your Delivery Pass will be automatically renewed for the same term unless you tell us that you wish to cancel the service. Except for monthly passes, you will be sent a reminder 28 days before the renewal payment is taken from your card. You may cancel the renewal in accordance with our cancellation policy at Term 8 below.
1.4 There are two levels of membership available: an anytime Delivery Pass and a Midweek Delivery Pass. The prices for our Delivery Pass services are shown on our website here.
2. Delivery Pass Options:
2.1 There are two levels of membership available: Anytime Delivery Pass and Midweek Pass. The Anytime Pass is available for periods of 1, 6 or 12 months. The Midweek Pass is available for periods of 1 and 12 months.
2.2 The Anytime Delivery Pass entitles you to, subject to term 7, up to one free Delivery Pass delivery or Click & Collect service per day during your membership. If you receive more than one delivery per day, including where available, click and collect from selected store locations, the second order placed for delivery or collection on that day will be charged the usual rate as advertised on our website. Our delivery and Click & Collect service is not available on 24-26th December each year.
2.3 If you purchase an Anytime Delivery Pass you may choose any delivery or Click & Collect slot available on your chosen delivery day, including where available in our trial locations, a To you today, same day delivery or Click & Collect slot.. The Anytime Delivery Pass does not guarantee you the delivery or Click & Collect slot of your choice. All slots shown as available on the online slot booking page are available for your Anytime Delivery Pass order.
2.4 The Midweek Delivery Pass entitles you to up to one free Delivery Pass delivery or Click & Collect service per day on Tuesday, Wednesday and Thursday each week during your membership. If you receive more than one delivery per day, including where available, click and collect from selected store locations, the second order placed for delivery or collection on that day will be charged the usual rate as advertised on our website. If you select a delivery or Click & Collect slot on any other day, you will be charged the usual rate as advertised on our website. Our delivery and Click & Collect service is not available on 24-26th December each year.
2.5 If you purchase a Midweek Delivery Pass you may choose any available delivery slot available on Tuesday, Wednesday and Thursday during your membership, including where available in our trial locations, a To you today, same day delivery or Click & Collect slot. The Midweek Delivery Pass does not guarantee you the delivery or Click & Collect slot of your choice. All slots shown as available on the online slot booking page for Tuesday, Wednesday and Thursday are available for your Midweek Delivery Pass order.
2.6 All orders are subject to a minimum order value of £40 after any discounts or non-Sainsbury’s e-vouchers have been deducted. Orders under £40 will be charged the usual delivery rate for the selected delivery slot as shown on our online booking page.
3. Purchase and Payment details
3.1 You may pay for your Delivery Pass using any valid Debit or Credit card already linked to your existing ‘My Account'. Alternatively you may register a new card at the time of payment.
3.2 Your access to the Delivery Pass service will commence once we have notified you by email that we have received payment. Your account will be activated as soon as we have received payment. If you have any pending orders, you will need to check them out again to ensure that delivery charges are not applied.
3.3 If we are unable to process payment your Delivery Pass service will not commence until we are able to do so. If we are unable to process a renewal payment, your Delivery pass membership will be suspended until such time as we are able to do so.
4. Evouchers
4.1 From time to time we may offer Delivery Pass e-vouchers. Evouchers may only be used subject to these terms and conditions and any additional terms and conditions detailed on the evoucher.
4.2 Evouchers are, and remain at all times the property of Sainsbury's Supermarkets Ltd. The right to use an evoucher is personal to the original or named recipient and may not be transferred without permission. It may not be copied, reproduced or published either directly or indirectly. Evouchers distributed or circulated without our prior written approval are not valid and may be refused or cancelled. If you redeem or attempt to redeem an evoucher to which you are not entitled you may be committing an offence.
4.3 Sainsbury's reserves the right to cancel or withdraw any evoucher or promotion at any time without notice and without reason.
4.4 Unless otherwise stated an evoucher may be used only by the named recipient, it may only be used as stated on the evoucher and not in conjunction with any other offer or evoucher. Evouchers cannot be exchanged for cash or gift vouchers.
5. Delivery Pass Guarantee
5.1 We guarantee that using an Anytime or Midweek Delivery Pass will cost you less than our standard grocery delivery charges.
5.2 During your Delivery Pass membership we'll add up the cost of the delivery slots you used at the standard prices shown on our website. When your Delivery Pass membership expires, and before we auto renew your membership, we will automatically compare the price you paid for your Delivery Pass with the cost of the delivery slots you've used. If the total cost of the individual delivery slots used by you does not at least equal the cost of your Delivery Pass we'll give you an online grocery voucher for the difference.
5.3 Any voucher issued as a result of the Delivery Pass Guarantee may be used by you as part payment of a Sainsbury's online grocery delivery order within 6 months of issue. The expiry date will be shown clearly on the voucher. The voucher may not be used instore.
6. Nectar
6.1 Purchase of a Delivery Pass qualifies for Nectar points at the rate of 1 point per £1.
6.2 You may not redeem Nectar points in full or part payment for Delivery Pass.
7. Fair Usage
7.1 Delivery Pass operates a fair usage policy. We reserve the right to suspend or cancel your membership of the Delivery Pass service if we consider that your use is not reasonable.
7.2 Delivery Pass may be used only in association with the registered Sainsbury's Online Grocery account and by the registered account holder only. It may not be used by other users. It may be used to deliver to an address other than your delivery address (such as a holiday home).
7.3 Delivery Pass may only be used for domestic use for the purposes of purchasing groceries for your immediate household. We reserve the right to ask for proof that you are associated with all delivery addresses.
7.4 Customers are limited to one free Delivery Pass delivery or collection between 20 and 23 December.
8. Cancellation
8.1 You have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to change your mind without giving a reason and cancel your Delivery Pass membership within 14 days from the day after purchase unless you advise us, by using your Delivery Pass, that you wish the Service to start immediately. Use by you of the Delivery Pass at any time within the 14 day Cancellation Period confirms your acceptance to start the Service. The Delivery pass cannot be cancelled more than 14 days from the day after purchase.
8.2 If you have not used your Delivery Pass and decide to cancel it you must call us within 14 days from the day after purchase and we will issue a full refund. The refund will be credited to the card used for payment within 3-5 working days. You will receive a confirmation email when the refund has been processed.
8.3 If you have used your Delivery Pass but cancel it within 14 days from the day after purchase we will issue a refund. We will refund the amount you paid but will deduct the full cost, as advertised on our website, of the slots used by you, whilst using the Delivery Pass. The refund will be credited to the card used for payment within 3-5 working days. You will receive a confirmation email when the refund has been processed.
8.4 If your Delivery Pass was purchased using an e-voucher and you cancel your Delivery Pass within 14 days from the day after purchase your refund will be based on the membership fee you paid and not any other rate for the Delivery Pass.
8.5 Once you have purchased a Delivery Pass it is not possible to amend an Anytime Pass to a Midweek Pass, or upgrade from a Midweek Pass to an Anytime Pass until your membership expires. You may change your membership type after it has expired by contacting us on 0800 328 1700.
8.6 Delivery Pass membership will be automatically renewed after your membership has expired. Except for a 1 month pass, we will send a reminder 28 days before payment is due. We will not send reminders for 1 month passes. If you do not cancel your membership, we will automatically take the renewal payment, at the rate then advertised on our website, or if lower at any rate quoted in your renewal reminder. The renewal payment will be taken from the card used at the time of registration or if available, a replacement card of the same type and number already registered to your account. If we are unable to process payment we will let you know. Your membership may be suspended until such time as payment is received. You may cancel the renewal before the renewal date by accessing the My Passes link through the My Account section on the Sainsbury's Grocery Online website or by calling our Customer Care Team on 0800 328 1700.
9. General information:
9.1 Delivery Pass may not be used if you intend to use the items delivered for resale or onward delivery by a 3rd party.
9.2 We reserve the right to charge a delivery fee if you or an adult is not available to receive an agreed delivery.
10. Delivery Pass change or termination
10.1 We reserve the right to change or withdraw Delivery Pass membership benefits or suspend the delivery pass service at any time and for any reason.
10.2 We reserve the right to change and update these terms and conditions from time to time. If we do so, we will update our website with the revised terms and conditions and will send an email to Delivery Pass members detailing any material changes.
10.3 We reserve the right to monitor usage of the Delivery Pass and to terminate individual membership of the Delivery Pass service if we believe that:
- A member is in breach of the fair usage policy
- A member is in breach of any term or condition
- A Delivery Pass member has engaged in activity that we suspect involves fraud or the misuse of Delivery Pass membership
In such cases no refund will be issued by Sainsbury's.
11. Our Liability
11.1 Our liability for any loss you suffer as a result of us breaching this agreement is strictly limited to the purchase price of the Delivery Pass.
11.2 This does not include or limit in any way our liability:
(a) For death or personal injury caused by our negligence;
(b) Under section 2(3) of the Consumer Protection Act 1987;
(c) For fraud or fraudulent misrepresentation; or
(d) For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
11.3 We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us and even if such losses result from a deliberate breach of these Terms by us that would entitle you to terminate the contract between us, including but not limited to loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings; or loss of data.
